Bug with "Select which categories exclude"

Hello,
I just found a bug with the “Select which categories exclude” field.

If you have categories, which doesn’t have any posts then these are not shown on the field “Select which categories exclude”.

But on the frontpage search settings, below the “Filter by Categories” shows the categories which doesn’t have any posts.

I would be glad if you could exclude them from the frontpage search settings also (the categories which doesn’t have any posts).
